The following Terms and Conditions apply to any individual or organization (“Client”) making payments for corporate gifting services provided by Khaas, a division of ObserveNow Media. This includes but is not limited to bulk orders, personalized gifting solutions, festive hampers, and subscription-based gifting services, made through the online payment gateway on the official website https://www.observenow.com or any affiliated digital platform.
Please read these Terms and Conditions carefully before proceeding.
1. Acceptance of Terms
By initiating an online payment on the Khaas platform, the Client acknowledges that they have read, understood, and agreed to be bound by these Terms and Conditions. The act of completing an online payment constitutes full acceptance of these terms without limitation or qualification.
2. Scope of Agreement
These Terms and Conditions constitute a binding agreement between the Client and ObserveNow Media (Khaas division). They supersede any prior verbal or written communication regarding the payment or service being availed.
ObserveNow Media reserves the right to amend, update, or modify these Terms at any time without prior notice. Continued use of the payment gateway after such modifications constitutes acceptance of the revised terms.
3. Governing Law and Compliance
Khaas, as a service of ObserveNow Media, operates under the jurisdiction of the Republic of India. All payment processes and records shall comply with the applicable Indian laws, financial regulations, and data protection standards.
Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts in Delhi, India.
4. Payment Policy – Credit Card (POS) and NEFT Transfers
Khaas accepts two official modes of payment for its corporate gifting services:
- Credit/Debit Card Payments via Bank POS Terminal
- Bank Transfers via NEFT (National Electronic Funds Transfer)
These options ensure secure and traceable transactions between the Client and Khaas.
A. Payments via Credit/Debit Card (POS Machine)
Payments can be made in person using a valid debit or credit card through authorized Point-of-Sale (POS) terminals at the ObserveNow office.
A printed or digital transaction receipt will be provided immediately upon successful swipe and serves as official proof of payment.
Policy Guidelines:
- The Client must use a valid, functional card with sufficient balance.
- ObserveNow Media shall not be responsible for:
- Failed transactions due to card errors or insufficient funds
- Duplicate charges from repeated attempts
- Delays or failures caused by third-party bank systems
- All transactions are final and irreversible, unless explicitly covered under the refund policy.
B. Payments via NEFT (Bank Transfer)
Clients can also pay via NEFT to the official bank account of ObserveNow Media (details provided via official invoice or communication).
Policy Guidelines:
- Clients must mention their company name, contact, and order ID in the remarks field.
- A UTR number or transaction screenshot must be shared with the Khaas team via email or WhatsApp.
- Order confirmation will only be issued once the payment is successfully credited and verified.
ObserveNow is not responsible for:
- Transfer delays or wrong account credit due to client error
- Incomplete or incorrect payment references
- Missed deadlines due to payment delays
Important Notes:
- All payments are subject to the terms outlined in the Refund and Cancellation Policy.
- Khaas does not accept cash payments or wallet transfers.
- No order will be processed unless full payment is received and confirmed.
5. Rights of ObserveNow Media (Khaas)
ObserveNow reserves the right to:
- Suspend or deny access to the payment facility at its discretion
- Reverse or reject a payment in case of suspected fraud or misuse
- Withhold order processing until payment is verified
6. No Liability for Technical Errors
ObserveNow Media and its Payment Gateway Providers will not be liable for:
- Technical errors, downtime, or disruptions during the transaction process
- Delays or data losses due to connectivity issues
- Consequential losses due to payment failures or processing delays
Clients are advised to use the payment facility at their own risk.
7. Confirmation and Receipt
Upon successful payment, the Client will receive an email and/or SMS confirmation. Khaas is not responsible for confirmations that are not delivered due to spam filters, incorrect contact information, or network errors.
Discrepancies must be reported within 72 hours of payment, along with proof of transaction.
2. Refund and Cancellation Policy
Khaas – Refund and Cancellation Policy
We aim to offer transparent and client-friendly practices. The following policy applies to gifting services ordered through Khaas:
General Corporate Orders:
- Cancellations must be requested in writing via email to the Khaas team.
- Full refunds are granted for cancellations made at least 7 business days prior to the scheduled dispatch date.
- 50% refunds will be provided for cancellations between 3–6 business days prior to dispatch.
- No refunds will be issued for cancellations made within 72 hours of dispatch or for processed orders.
Custom/Personalized Orders:
- Once production has begun on personalized gifts (logo printing, custom packaging, etc.), no refunds can be issued.
- Design approvals are binding once signed off by the client.
- In some cases, partial refunds or credits may be offered at the discretion of Khaas.
Subscription-Based Gifting Plans:
- Cancellations of gifting subscriptions must be communicated 15 days prior to the next cycle.
- Mid-cycle cancellations are non-refundable.
Dispatch Delays or Errors:
- In case of errors by Khaas (wrong item, quantity, or personalization), replacements will be arranged at no additional cost.
- For event cancellations by the client, only unshipped items are eligible for consideration under refund policy.
Processing:
- Refunds (if applicable) will be processed to the original payment source.
- ObserveNow is not responsible for any transaction charges deducted by the payment gateway or banks.
3. Shipping and Delivery Policy
Khaas – Shipping and Delivery Policy
This policy applies to all physical gift items, hampers, and merchandise shipped by Khaas under ObserveNow Media.
Delivery of Orders:
- Corporate orders will be delivered to the address provided during checkout or order confirmation.
- For bulk orders, shipping may be centralized or split as per client instructions (if agreed in advance).
Shipping Timelines:
- Standard dispatch timeline is 5–15 business days after payment and order confirmation.
- Express or priority delivery may be arranged at additional cost, subject to availability.
- International shipping is currently not supported unless explicitly agreed upon in writing.
Shipping Charges:
- For addresses within India, standard shipping is included unless stated otherwise.
- Additional charges apply for express delivery, remote area surcharges, or redelivery due to failed attempts.
Address Accuracy:
- Clients are responsible for providing accurate and complete shipping details.
- ObserveNow is not liable for delays or returns due to incorrect addresses.
Courier & Tracking:
- We use trusted delivery partners (e.g., Bluedart, DTDC, India Post).
- A tracking ID will be shared once the order is dispatched.
- Any delivery-related issues must be reported within 72 hours of receipt.
Damages & Replacements:
- Damaged or missing items must be reported with photographic evidence within 48 hours of delivery.
Khaas will provide a replacement or credit note, depending on the nature of the issue.
