  • “Payment Instrument” includes NEFT, UPI, credit cards, debit cards, and other bank-authorized digital payment methods accepted by Khaas.

Merchant’s Rights

By using the platform, you agree that ObserveNow may collect and process the personal and organizational details you provide for executing the gifting order, confirming payments, and managing post-order communication.
 We may also contact you regarding upcoming offers or similar services unless you opt out from such communication.

Your Responsibilities

You are solely responsible for providing accurate and complete information including recipient details, shipping addresses, customization inputs, and billing information.
 You also agree that the Payment Instrument used is lawfully yours and carries sufficient funds for the Transaction.

Khaas shall not be liable for:

  • Payment failures due to incorrect bank details or card issues
  • Delays caused by wrong address or incomplete customization input
  • Any errors resulting from the Client’s failure to double-check the order information

Prohibited Activities

You agree not to engage in any of the following while using KhaasGifts services:

  • Misrepresenting your identity or placing orders under false credentials
  • Attempting to manipulate or reverse-engineer the payment or backend systems
  • Uploading or sharing malicious code or unauthorized content
  • Harassing Khaas staff or vendors through communication channels
  • Sharing confidential pricing or design templates without consent
  • Reselling or redistributing Khaas products under your own branding without authorization

Violations may result in termination of service access and possible legal action without refund.

Limitation of Liability

KhaasGifts liability is limited strictly to the refund or replacement of products/services that are not delivered as agreed, subject to our Refund and Cancellation Policy.
 KhaasGifts does not accept liability for indirect or consequential damages, such as business loss or missed occasions.
 You agree to indemnify and hold harmless ObserveNow Media and its affiliates from any claims arising from your misuse of the KhaasGifts platform or breach of these Terms.

User Reviews and Public Comments

KhaasGifts may allow you to submit feedback, testimonials, or reviews. By doing so, you confirm that:

  • Your feedback is based on actual experience
  • It does not include defamatory, offensive, or illegal language
  • You are not incentivized by a competitor or third party
  • You are not engaging in reputation manipulation campaigns

KhaasGifts reserves the right to approve, edit, or remove any user-submitted content.
 By submitting a review, you grant KhaasGifts a royalty-free license to use the content for promotional and archival purposes.

Governing Law and Dispute Resolution

These Terms shall be governed by the laws of India.
 Any dispute arising out of these Terms or related to the KhaasGifts platform shall be subject to the exclusive jurisdiction of courts in Bengaluru, India.

In the event of a dispute, both parties shall attempt amicable resolution within 30 days. Failing which, the matter shall be referred to arbitration under the Arbitration and Conciliation Act, 1996, with the arbitration conducted in English and held in Bengaluru.

If no mutual arbitrator is appointed, one shall be designated per applicable law. The decision shall be binding.
 KhaasGifts reserves the right to seek injunctive relief for misuse or violation of its intellectual property.

Grievance Redressal

If you encounter issues related to payments, product delivery, duplicate charges, or refunds, you may reach out to the KhaasGifts support team using contact details available on the website.
 We will acknowledge all grievances within 48 hours and aim to resolve them within 7–10 business days.

Disclaimer

By completing a transaction with KhaasGifts, you affirm that you are entering a legally binding agreement and that the funds used are legitimate and authorized.

You agree that all payments are made at your own discretion, and we are not liable for:

  • Declined payments
  • Unauthorized transactions
  • Technical failures during checkout

Any information shared with us may be disclosed only in accordance with applicable laws, or to prevent fraud.
